EPE Sues Economic Development Board

Elvis Presley Enterprises has sued an economic development board in an attempt to force a vote on incentives to expand the Graceland complex.

The lawsuit cries foul over alleged interference by city government and the Memphis Grizzlies, while asserting that the city, Shelby County and team aren't parties to the legal action.

Elvis Presley Enterprises filed the Shelby County Chancery Court lawsuit Friday against the Economic Development Growth Engine (EDGE) of Memphis and Shelby County.

The lawsuit seeks an injunction barring the EDGE board from not voting on the Graceland applications. A hearing was scheduled for April 16.

The filing came two days after the EDGE board tabled an application for incentives, citing fears of a legal challenge from Graceland or the Grizzlies.

The board voted March 21 to schedule a special meeting to hear two Graceland projects: a $20 million bond issue for exhibit space addition, which was up for a vote that day, and a previously proposed $110 million request for bond financing of a 6,200-seat performance venue.

Graceland officials say the city and Grizzlies have opposed their expansion based on an interpretation of a FedExForum non-compete agreement.

City chief legal officer Bruce McMullen on Monday denounced the latest lawsuit as a negotiating tactic. “It appears that EPE is once again using the Courts to aid them in negotiations over what is allowable use of TIF funds.  Immediately after this latest suit was filed, we received some settlement proposal requesting TIF funds (taxpayers money) but no information on the justification for the tax money nor clarity on how it would be used. The suit appears to be a negotiation tactic.”

The EDGE organization declined comment.

A TIF (tax increment financing) district was one of the measures put in place by the city, county and EDGE board in 2014 to help Graceland build a resort hotel, The Guest House at Graceland, and a 220,000 square foot exhibit complex, Elvis Presley's Graceland, which opened last year.

Graceland last year proposed to increase its share of a tax increment financing (TIF) revenue to help finance the performance venue. The increase requires approval by EDGE, the City County and Shelby County Commission.

The EDGE board is an industrial development board with authority to grant property tax abatement, issue bonds and take other actions to spur economic activity.

Graceland sued the city, county and Grizzlies' owner Memphis Basketball LLC last fall in Chancery Court, seeking a declaratory judgment on whether the FedExForum non-compete agreement applied to Graceland's proposed performance venue.

A judge dismissed the lawsuit in February. The ruling said in part that the court couldn't consider Graceland's complaint before its application was voted on.

The latest delay by EDGE came after board member Tom Dyer said he feared the board would be sued by the Grizzlies if it approved the incentive and by Elvis Presley Enterprises if the incentive was rejected.

Dyer's comments prompted the Grizzlies to make a statement through the team's attorneys, saying in part: "To be clear, Memphis Basketball has never directly or indirectly threatened to sue EDGE with respect to any EPE initiative or otherwise, nor does it intend to do so."

The lawsuit contends Dyer offered to vote for the incentives if the Grizzlies give written approval of the Graceland expansion or a court issues a final, non-appealable order stating that the facilities don't violate the non-compete agreement.

"Put simply, as it relates to EPE, EDGE essentially is improperly surrendering its power and authority to The City and Memphis Basketball," the lawsuit states.

The non-compete clause grew out of decision by public officials to steer concert business to the FedExForum after the $250 million public arena opened in 2004.

Elvis Presley Enterprises contend the clause doesn't apply to a private projects.

I Walk The Line with Children For The Good Times

Three new import-sets have been released; “I Walk The Line”, “For The Good Times - Elvis On Tour” And “Elvis Sings For Children and Grownups Too". The first set is from the Redemption label.

Details I Walk The Line

It’s August 1970, the recordings for the MGM movie “That’s The Way It Is” are finished and Elvis still has more then 3 weeks to go at the Las Vegas International Hotel before starting another short (but busy) one week tour.  Elvis is very inspired, in a good mood, funny and in a fantastic physical condition.

All of which resulted in the magnificent August & September performances.  Unfortunately, the only soundboard/multitrack material that has seen the light of day are the “That’s The Way It Is” performances.  Lucky enough these audience recordings survived!

The August 14 1970 show has always been considered a very remarkable show, especially as Elvis is singing some unusual songs, like the 2 Johnny Cash songs: “I Walk The Line” and “Folsom Prison Blues”. The August 14 show had some volume issues as appeared on the original tape, probably because of hiding the recorder. This has been corrected where possible. All performances have been re-edited and remastered and speed corrected where necessary.

Also featured is the original August 10, stage rehearsal remastered from scratch using an original transfer of the reel. Without any edited or added intro or outros, just as recorded! A wonderful improvement to the original release from the 90's! These shows are too good to be missed in any collection!

The set contains no previously unreleased material:
  • August 14 1970 Midnight Show - The Man In White Vol. 3 - Get Dirty

March 22 - Vic Colonna Died

Sam Theaker, aka Vic Colonna a bootlegger who brought us many fine releases (in cooperation with Paul Dowling) in the seventies and early eighties has died. Apparently he lost the battle agains cancer.

Some of his releases were "Behind Closed Doors", The Burbank Sessions", "The ’68 Comeback", "From The Waist Up", "The Dorsey Shows", "Rockin' Rebel", the 1961 "Hawaii Benefit" and so many more all featuring unreleased classic Elvis recordings.

Sam Theaker aka Vic Colonna was one of the great names from this mysterious world that many fans will recall. It was the popularity of Elvis Bootlegs that paved the way for the alternate take compilations by Ernst Jorgensen and Roger Semon to create the ‘FTD’ Fan Club label. Sam Theaker was an essential part of the Elvis legacy but sadly has been battling cancer over the last few years and unfortunately never saw his brilliant book about the exciting world of Elvis bootlegs published.

Details “His Hand In Mine”:

Elvis Aaron Presley was born during the Great Depression into a poor family in Mississippi. They moved to Memphis during the early fifties, and as a struggling young truck driver, Elvis cut some demos as a gift for his beloved mother Gladys.
The folks at RCA Victor knew that this young fellow named Elvis was destined for superstardom. They quickly signed the legend to a long-term deal, and his first RCA single "Heartbreak Hotel" forever etched “The King Of Rock And Roll” trademark to his name. He would eventually become the most successful solo artist of all time!

As 1960 was coming to a close, Elvis returned to the studios of RCA Nashville and would go on to record his first smash gospel album His Hand In Mine. Ever proving that he was indeed on top of his game, the amazing album featured a dozen of his most soulful works ever captured on wax like the hit single Crying In The Chapel and more stellar fare such as I Believe In The Man In The Sky, Joshua Fit The Battle and of course the definitive classic title track His Hand In Mine. The Lp soon went on to achieve gold and platinum status and become one of his most memorable titles in his huge arsenal of masterful albums.

Thanks to his great soulful country workouts on Known Only To Him and the wonderful Milky White Way, this collection of Elvis Presley’s gospel hits were just what the fans were yearning for, as the entire album was built around his love for gospel and old time religious church music.
