December 29 - I Don't Wanna Be Tied

The Dutch Almost In Elvis fan club always comes up with original themes and designs for their magazines. The latest edition "I Don't Wanna Be Tied" is presented as a book. It is a book with a hard cover, 96 pages (glossy 150 gram paper) filled with around fifty pictures (half in black and white and other half in full color) and some funny illustrations to emphasize the theme.

On the back of the hardcover book can be read: "His first hit, Heartbreak Hotel, started to climb the charts when he let his pelvis speak on television. America was confused and intimidated when the young singer started his shock and awe campaign with his degenerated and vulgar movements that deflowered pop music."

December 18 - The Complete Concert Recordings

Memphis Recording Service announced it's first release in 4 years titled "Elvis Live In The 50's - The Complete Concert Recordings". The set is due February 19, 2016. The set is available for pre-order on Amazon. The more people who pre-order it the cheaper it will get before the release date.

From the press-release:
This box set is the ultimate tribute to Elvis Presley documenting his shows from the 1950's. The 3 CD's represent for the first time ever, the release of the complete collection of archival live concert recordings (including rare interviews and the recently discovered new material) by Elvis Presley in the 1950's.

All of the 82 tracks included have been painstakingly remastered and restored. Fans who enjoyed previous mastered works of the MRS team such as 'Such a Night in Pearl Harbor', 'The Complete Hayride Archives' and Boxcar's remastered works of the Orlando February 1977 concert, are in for a treat. Our restoration techniques have now been applied to the Tupelo shows as well as the Eagles Hall, Frontier and Robinson Auditorium shows. Combined with further works on the Hayride and others shows, the quality of these recordings is now far superior to ever before.

The 172 page book is a chronological photo journey following Elvis from the very first to the very last shows performed in the 1950's. It contains linear notes that includes every show listing (now updated) and is accompanied by hundreds of photographs many of which are rare and unpublished.

December 16 - Songwriter Luigi Creatore Died

Luigi Creatore, who with his cousin Hugo Peretti, had a career as a composer and producer that spanned three decades, has died at the age of 93 from pneumonia, his wife told the New York Times today. The pair either composed or produced a wide range of artists, including Elvis Presley, Sam Cooke, Jimmie Rodgers, the Who, Billy Fury, Bob Dylan, Andy Williams, Judy Collins, Kenny Rogers and Marty Robbins.

Creatore, born in New York City, began his career with Perretti at a wedding reception for Creatore's brother. Hugo and Luigi, as they were known, had some of their earliest success in 1957 at Roulette Records. They produced Jimmie Rodgers “Honeycomb,” which hit No. 1 on the U.S. Billboard pop charts, and No. 7 on the country charts. The follow-up, “Kisses Sweeter Than Wine,” rose to #3 in the U.S. pop charts and No. 6 in the country charts.

They then moved to RCA Victor, working with Perry Como, Sam Cooke and Ray Peterson. Among the records they were credited on were the Tokens' “The Lion Sleeps Tonight,” Sam Cooke's “Chain Gang,” “Twistin' the Night Away and “Another Saturday Night,” the Isley Brothers' “Shout” and Little Peggy March's “I Will Follow Him.” They co-wrote “Can't Help Falling in Love” with George David Weiss for Elvis Presley. The song hit No. 2 in 1961 on Billboard. The pair also composed “Wild in the Country” for the King.

December 13 - That's The Way It Is Bootlegger

On the FECC forum a posting hinted on an upcoming release from the "new" International import-label containing "That's The Way It Is" material on 8 CD's and a dual layer DVD, accompanied by a book. But there are also postings that the persons behind the label have problems financing it ... guess we will have to wait and see.

The posting:
This 8-CD + dual layer DVD plus Book will contain everything from these rehearsals. Finally, you are getting these rehearsals uncut, straight from actual tapes, which have not been used before in full. All rehearsals including the August 4th, 7th and 10th rehearsals are now presented more complete than before. The dual layer DVD contains all rehearsal footage shot, including new footage. Count on at least 20 minutes of footage that will surprise even hardcore fans!

Due to our extensive research and obtaining material from various sources, this box-set has been known about for a while in the import scene. Someone has taken advantage of that knowledge, and has now released a cheap knock-off version of our concept. Do not fall for this. You deserve the best, and International’s version is the definitive version and the final word on these rehearsals. It is a more complete and far more elaborate box-set. Our box set includes a 250+ page book stuffed with both t known as well as many rare shots, many of them in color, including a few from August 10th that will knock your socks off!! … 300 photos in all, many of them sourced from the actual negatives.

The book contains an in-dept text on these rehearsals, written with authority by one of the leading Elvis experts. The text will give you various new details and insights. Also added are several reproductions of original TTWII souvenirs. The set is housed in a beautiful slipcase cover.

All the audio and footage have been newly remastered using the latest technology… a real audio / visual treat, made by real fans for the fans.

Originally, we wanted to wait with the announcement until January 8th, but now that a cheap knock-off version is coming out, we wanted to let the fans know that the real deal is coming soon, brought to you by the reactivated International label. We believe that our track record speaks for itself. The other set contains nothing new, and has simply used the Gravel Road releases on these rehearsals. Now it’s up to you, the fans to decide whether you want to soar with the eagles (us)…. Or roast with the turkeys (the cheap knock off). In our view, the choice is clear. We have several other surprises in store for you in 2016 and ’17, just wait and see.

For now, enjoy this spectacular new set, lovingly researched and compiled from the actual sources, containing more material than before, and remastered with expertise for the best sound possible… a true winner.

Feedback during proofreading:
“The book is so much more than a bunch of pix and original reviews as we've come to expect in the import scene.”

“This book could be a worthy release all by itself, as it presents a coherent overview on these rehearsal sessions, taking you from one rehearsal to the next, both with fascinating text and details, as well as stunning photos from the actual rehearsals”. This is the real deal, daddy-O, you better believe it! Order your copy today and be pleased with the knowledge that you will soon have the absolute best.

December 12 - EPE vs. Sony

There have been rumors of a "Complete Box" containing all of Elvis Presley's original albums and several compilations. Apparently a date has been set, January 8, 2016.
Following the box-set in the spring of 2016 is re-issue of the deluxe edition of the "If I Can Dream" release.

EPE vs. SONY

In the 1970s, the King and the Colonel got a $5.4 million buyout, but then copyright was extended, and consumers moved to digital outlets like iTunes and Spotify.

Elvis Presley has left the building, but the digital income issues that have bedeviled more contemporary musicians have hardly escaped the King.

His estate is currently battling a subsidiary of Sony Music in Germany over foreign royalties. This month, the four-year-old legal battle spilled into a New York federal court as Elvis Presley Enterprises contends with Sony's corporate structure and intercompany licensing agreements and looks to obtain more documentation on how Presley's musical works have been exploited.

In 1974, Presley entered into a buyout agreement with RCA, terminating all previous agreements between the musician and the record company. As part of that deal, Presley got $2.8 million, and his manager "Colonel" Tom Parker got $2.6 million.

What the King didn't see coming was copyright term extensions that would push back the date when his songs entered the public domain. A lot more revenues would be enjoyed by the owner of such hits as "Love Me Tender" and "Hound Dog." In Germany, for example, where Presley was once stationed as a soldier in the Army and remains popular, the copyright to his songs were once scheduled to expire in the 1990s whereas now they enjoy another twenty to thirty years of protection. Here's a chart in the plaintiff's papers:

Backed by a private equity firm, Elvis Presley Enterprises went to court in Germany looking to amend the buyout contract for more "equitable remuneration."

Thanks to decisions by several regional and appeals courts in Munich, Elvis Presley Enterprises is only being allowed to pursue royalty claims since 2008. In July 2013, an appeals court set the level of equitable remuneration on phonograms (or physical sound recordings) at 13 percent of the recommended retail price. And as one can see by the following chart, those revenues have been on the decline. The "revenues earned" represent the published price to dealer while the "net to owner" represents what Sony Music Entertainment Germany pays to Sony subsidiary Arista Music, which has the effect of lessening any royalty share to the Presley estate.

While revenue earned on phonograms continues to dwindle, money from digital exploitation is unsurprisingly headed north. Here's another chart concerning digital royalties that plaintiffs have constructed from their review of Sony documents:

Naturally, Elvis Presley Enterprises wants a bigger share of this pie and is treading on arguments that have come up in American courts by other prominent musicians.

"It is standard practice in the case of licensing revenues for authors and performing artists that authors and performing artists have a 50% share of the royalties earned and that the equitable remuneration for performing artists of the status of Elvis Presley are at a level of a 50% share also in respect of royalties which the record producer earns," states an English translation of the complaint that's been filed. "These also include revenues from digital exploitation because the Defendants do not sell those files themselves rather they grant exploitation licences to third parties, for example iTunes, Amazon.de or Spotify."

The money being pocketed for Elvis songs in Germany also includes public broadcast income as well as other sources.

As for what Elvis Presley Enterprises has actually gotten from the Buyout Agreement for 2008-2013, the inflation adjusted remuneration has been calculated at $245,945 compared to $6.3 million allegedly reaped by Sony entities.

"As there were at least 1,080 songs which were covered by the Buyout Agreement, the sum per song per year which Elvis received for all exploitations in Germany was a ridiculous USD 35.42 (after adjustment for inflation!)," complains the plaintiff to a German court. "The Defendants cannot escape a claim under Sec. 32a German Copyright Act simply through clever distribution of their income within their corporate group."

Here's a copy of the Elvis Presley complaint translated from German as well as a declaration in support of discovery upon Sony

December 11 - My Platinum Happiness

Jack White's Third man Record re-issued "My Happiness" coupled with "That's When Your Heartaches Begin" as a 7 inch Sun Records Reissue of the Grammy Nominated Record Store Day Exclusive 10-inch facsimile of Elvis Presley’s first ever recording from 1953.

Product description:

Third Man will release a widely available 7-inch 45rpm featuring newly restored versions of the two songs. Working from a transfer done by industry expert Alan Stoker at the Country Music Hall of Fame, the audio will be as clean as modern technology can make it without losing the feeling and soul that makes these two songs both haunting and breath-taking.

An 18-year-old Elvis Presley walked through the doors of the Memphis Recording Service at 708 Union Ave. in the summer of 1953. He carried a beat-up guitar that he'd had since the age of 11 and enough money to make a $3.98 record of his own voice. He sang two '30s ballads -- ''My Happiness'' and ''That's When Your Heartaches Begin'' -- hoping to catch the attention of Sam Phillips, who had started his own label, Sun. When he was done, Marion Keisker, who helped run the place with Phillips, typed his name on the back of a label for Sun act The Prisonaires, and Presley left with his acetate. For more than six decades, that record of Elvis singing ''My Happiness'' was kept by the family of the high-school friend Presley left it with, Ed Leek. As part of an auction at Graceland on Jan. 8 (2015) -- which would have been Presley's 80th birthday -- it was valued at approximately $100,000. It sold to an unknown Internet bidder for $300,000. That bidder was Jack White. A piece of American musical history.

Easy Come, Easy Go

One of the rarest Elvis LPs in the world. ’ Easy Come, Easy Go ‘’ (released in Australia and New Zealand). A real rarity, Issued in 12" format only in Australia and New Zealand back in 1966 and at the time the only place to hear the original soundtrack in stereo and still the only place to get them on RCA vinyl. The LP had the distinction of being "bootlegged" with the bootleg issue (for a time) selling at a higher price than the official RCA release. This LPwas released on CD some years ago but with very bad audio quality.
Now, housed in a neat glossy card sleeve, you can hear the original album in great sound including some extra bonus tracks, most of them unreleased by Elvis’ official label. A great collectors’ item !

Easy Come, Easy Go - The Love Machine - Yoga Is A Yoga Does - You Gotta Stop - Sing You Children - I’ll Take Love - She’s A Machine Tonight Is So Right For Love - G.I. Blues - Bossa Nova Baby - Vino, I Dinero Y Amor - Moonlight Swim - Can’t Help Falling In Love
